Terms of Service

These Terms of Service ("Terms") govern your access to and use of the mobile game Elarion: Roy's Adventure (the "Game" or "App"), as well as any related websites, content, features, and services provided by Derebey Network Technology (Shenzhen) Co., Ltd. ("we," "us," or "our").

By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Game.

1. Eligibility

You must be at least 13 years old to use the Game.

If you are under the age of 18, you represent that you have obtained permission from a parent or legal guardian to use the Game and to make any in-app purchases.

You may only use the Game in jurisdictions where such use is permitted by applicable law.

2. Account and Access

Some features of the Game may require an account or may be linked to your app store account, device, or platform profile.

If the Game allows account creation or account-based features:

  • you are responsible for maintaining the confidentiality and security of your account;

  • you must provide accurate and complete information;

  • you may not share your account with others;

  • you are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate access if we believe your account is being used in violation of these Terms or applicable law.

3. License to Use the Game

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Game for your personal, non-commercial entertainment purposes.

You may not use the Game for any commercial purpose unless we expressly authorize it in writing.

4. Rules of Conduct

When using the Game, you agree that you will not:

  • use cheats, bots, hacks, mods, exploits, automation tools, or unauthorized third-party software;

  • interfere with or disrupt the Game, servers, systems, or security features;

  • attempt to gain unauthorized access to the Game or related systems;

  • reverse engineer, decompile, disassemble, modify, or create derivative works based on the Game, except where such restriction is prohibited by law;

  • use the Game in any unlawful, fraudulent, abusive, or harmful manner;

  • infringe our intellectual property rights or the rights of others;

  • impersonate us or any other person or entity;

  • exploit bugs or unintended features for unfair advantage;

  • buy, sell, trade, or transfer accounts, virtual items, or in-game currency outside authorized channels, if any;

  • upload, transmit, or distribute malicious code or harmful content.

If the Game includes community, social, or user-generated content features now or in the future, you also agree not to harass, threaten, abuse, or post offensive, unlawful, or inappropriate content.

5. Virtual Items and In-Game Content

The Game may include virtual items, in-game currency, downloadable content, cosmetic items, upgrades, or other digital content ("Virtual Items").

All Virtual Items are licensed, not sold, to you for use solely within the Game, subject to these Terms.

You acknowledge and agree that:

  • Virtual Items have no real-world monetary value;

  • Virtual Items may not be redeemed for cash or anything of monetary value, except where required by law;

  • we may modify, rebalance, replace, suspend, or remove Virtual Items or gameplay features at any time for operational, legal, or game-design reasons;

  • you do not own any Virtual Items or in-game progression, except for the limited license granted under these Terms.

6. In-App Purchases

The Game may offer in-app purchases through third-party platforms, including:

  • Apple App Store

  • Google Play

All payment transactions are processed by the applicable platform provider, not by us directly. By making an in-app purchase, you agree to the applicable app store or platform terms.

Except where required by applicable law, all purchases are final and non-refundable.

If you want to request a refund, you must do so through the platform from which the purchase was made, such as Apple or Google, in accordance with that platform’s refund rules.

7. Updates, Changes, and Availability

We may update, patch, modify, suspend, discontinue, or restrict access to the Game or any part of it at any time, with or without notice, to the extent permitted by law.

We do not guarantee that the Game, or any feature or content within it, will always be available, uninterrupted, error-free, or compatible with your device.

8. Intellectual Property

The Game and all related content, including but not limited to:

  • game design;

  • software;

  • code;

  • gameplay systems;

  • artwork;

  • animation;

  • characters;

  • dialogue;

  • music;

  • sound effects;

  • logos;

  • trademarks;

  • text;

  • and other materials

are owned by or licensed to Derebey Network Technology (Shenzhen) Co., Ltd. and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, publicly display, publicly perform, republish, sell, license, or otherwise exploit any part of the Game.

9. Termination

We reserve the right to suspend, restrict, or terminate your access to the Game at any time, with or without notice, if:

  • you violate these Terms;

  • we suspect fraud, abuse, cheating, or unauthorized activity;

  • we are required to do so for legal, security, or operational reasons.

If your access is terminated, you may lose access to your Virtual Items, game progress, and other associated content, to the extent permitted by law.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Game is provided on an "as is" and "as available" basis.

We disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • the Game will be uninterrupted, secure, or error-free;

  • defects will be corrected;

  • the Game will always be available;

  • the Game is free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Derebey Network Technology (Shenzhen) Co., Ltd., its affiliates, directors, officers, employees, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, device failure, or business interruption, arising out of or related to your use of or inability to use the Game.

To the extent liability cannot be excluded, our total liability to you for any claim arising out of or relating to the Game or these Terms shall be limited to the amount you paid us, if any, for the Game during the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above may not apply to you.

12. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Derebey Network Technology (Shenzhen) Co., Ltd. and its affiliates, officers, directors, employees, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your use of the Game;

  • your violation of these Terms;

  • your violation of any law or the rights of a third party.

13. Privacy

Your use of the Game is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information.

14. Changes to These Terms

We may revise these Terms from time to time.

If we make material changes, we may provide notice by updating the date at the top of these Terms, posting the updated Terms on our website, through the Game, or by other appropriate means.

Your continued use of the Game after the updated Terms become effective constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Derebey Network Technology (Shenzhen) Co., Ltd. operates, without regard to conflict of law principles.

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Game shall be submitted to the courts of competent jurisdiction in the place where our company is registered, unless otherwise required by mandatory consumer protection law in your country or region.

If you are a consumer residing in a jurisdiction with mandatory legal protections, nothing in these Terms limits any non-waivable rights you may have under applicable law.
